Terms of Service

Welcome to Fish Club. These Terms of Service (the “Terms”) are a binding agreement between you and Fish Club LLC, a Utah limited liability company (“Fish Club,” “we,” “us”), covering your use of the Fish Club website, app, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1.Who can use Fish Club

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the permission of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service you represent that you meet these requirements and that any registration information you submit is accurate.

2.Your account

  • You are responsible for your account and everything that happens under it. Keep your password private and notify us promptly of any unauthorized use.
  • One account per person. Don’t share, sell, or transfer your account.
  • Usernames are first-come, first-served. We may reclaim usernames that are inactive, misleading, or infringe someone’s rights.

3.Fishing safety, licenses, legal access, and regulations

Fish Club is a record book and leaderboard — it is not a fishing guide, safety service, or legal authority. You are solely responsible for:

  • Holding a valid fishing license for every state and water where you fish.
  • Knowing and following all applicable fishing laws — seasons, limits, protected species, access rules, and catch-and-release requirements.
  • Legal access. Accessing every water lawfully. Never trespass on private property, cross posted land, or ignore closures to reach a water — no leaderboard spot is worth it, and a waterbody appearing on our map is not a representation that it is open to the public, reachable, or legal to fish from any particular location.
  • Assumption of risk. Your own safety — on the water and getting to and from it. Fishing, boating, wading, hiking, and driving to fishing spots involve inherent risks, including weather, currents, cold water, terrain, wildlife, and remoteness. You voluntarily assume all of those risks. Fish Club does not supervise, inspect, or endorse any location or activity and is not responsible for any injury, death, property damage, or loss that occurs on your trips.
  • Handling fish responsibly and legally.

Information on the Service about waterbodies, species, and regulations is provided for convenience and may be incomplete, outdated, or wrong. Always confirm rules with your state wildlife agency.

4.Your content

You keep ownership of the content you submit — catch entries, photos, profile details, club content, and messages (“Your Content”). So we can run the Service, you grant Fish Club a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, resizing photos), publish, and display Your Content in connection with operating, promoting, and improving the Service. This license ends when you delete the content or your account, except for content you shared publicly that others have re-shared, and copies kept in routine backups for a limited time.

  • Only submit content you have the right to share. Don’t post other people’s photos or catches as your own.
  • Public catches appear on leaderboards, water pages, and profiles at the waterbody level. Your exact coordinates are never shown publicly (see the Privacy Policy).
  • You are responsible for Your Content. We don’t endorse it and aren’t liable for it.

5.Verification and fair play

Fish Club’s value depends on honest records. By submitting a catch you certify it is real, caught by you, measured honestly, and caught legally. We may:

  • Approve, reject, flag, or remove any catch at our sole discretion, with or without explanation.
  • Use photo evidence, location signals, measurement checks, and moderator review in deciding.
  • Location signals.When you submit a catch for verification, we may collect your device's GPS position (with your permission) and/or GPS coordinates and timestamps read from your catch photo's metadata. These signals are optional, but catches with verified proximity are reviewed faster and unverified catches may be rejected. We use precise coordinates once — to check you were near the water you claim — and permanently delete them when review is decided. Photos are stripped of all metadata before upload and never reveal your location. Details are in the Privacy Policy.
  • Remove records, strip titles, suspend, or permanently ban accounts involved in faked catches, manipulated photos, measurement fraud, account sharing, or any other cheating.

Verification is our editorial judgment about a submission — it is not a guarantee or certification that a catch, measurement, or record is accurate.

6.Acceptable use

Don’t misuse the Service. Among other things, you agree not to:

  • Harass, threaten, or abuse other members, or post content that is hateful, obscene, or illegal.
  • Post content that documents or promotes illegal fishing (out-of-season take, protected species, poaching) or illegal access (trespassing, entering closed areas).
  • Reveal another person’s private information, including someone else’s private fishing spots, without permission.
  • Spam, advertise, or solicit other members without our permission.
  • Scrape, harvest, or bulk-download Service data; use bots or automation to access the Service; or interfere with its operation or security.
  • Reverse engineer, copy, or build a competing dataset from the Service.
  • Impersonate any person, misrepresent an affiliation, or submit reports in bad faith.

7.Clubs and chat

  • Club chat is visible to your club’s members. It is not end-to-end encrypted, and club staff and Fish Club moderators may review messages that are reported or flagged.
  • Club captains and first mates may manage rosters, applications, and messages in their club. We may remove clubs, names, mottos, crests, or emblems that violate these Terms.
  • Founding a club requires an active Pro membership. If the captain’s Pro membership ends, the helm transfers to an eligible teammate or the club is disbanded, as described in the app.

8.Fish Club Pro (paid subscriptions)

  • Auto-renewal. Pro is a subscription billed monthly or annually at the price shown at checkout. It renews automatically at the end of each billing period until you cancel.
  • Canceling. Cancel anytime from Manage billing in your profile. Cancellation takes effect at the end of the current billing period; you keep Pro until then. Except where the law requires otherwise, payments are non-refundable and we don’t give partial-period refunds.
  • Payments. Payments are processed by Stripe. We don’t store your card details. Applicable taxes may be added at checkout.
  • Price changes. We may change Pro pricing. Changes apply at your next renewal after reasonable notice, and you can cancel before they take effect.
  • Perks. Pro perks (flair, bait intel, club founding, and similar) may evolve over time. Pro never buys leaderboard placement — records are earned by fish. If you cancel, perks end with your billing period, except perks we’ve explicitly said you keep (such as the First Cast founders banner).

9.Fish Club’s content and brand

The Service — including its design, code, logos, graphics, text, and the compilation of records and leaderboards — belongs to Fish Club or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app and site as intended. Don’t use the Fish Club name, logo, or branding without written permission.

10.Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to support@fishclub.com with: (a) your contact information, (b) the work you claim is infringed, (c) the URL or location of the material, (d) a statement of good-faith belief that the use is unauthorized, (e) a statement under penalty of perjury that your notice is accurate and you are the owner or authorized to act for the owner, and (f) your physical or electronic signature. We respond to valid notices, remove infringing material, and terminate repeat infringers’ accounts.

11.Third-party services

The Service relies on third-party providers (for example Stripe for payments, Supabase for infrastructure, and map tile providers) and may link to external sites such as state regulation pages. Those services have their own terms and we aren’t responsible for them.

12.Ending your account

  • You can delete your account anytime from your profile settings. Deletion removes your profile and content as described in the Privacy Policy.
  • We may suspend or terminate your access (and remove content) if you violate these Terms, create risk for other members or Fish Club, or where required by law. Where appropriate, we’ll tell you why.
  • Sections that by their nature should survive termination (content licenses for shared content, disclaimers, liability limits, disputes) survive.

13.Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or secure, that records or verification decisions are accurate, or that any content (including regulations or waterbody information) is complete or current.

14.Limitation of liability

To the fullest extent permitted by law: (a) Fish Club will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill; (b) Fish Club is not liable for injuries, losses, or damages arising from fishing or outdoor activity, from other members’ conduct or content, or from reliance on information in the Service; and (c) Fish Club’s total liability for all claims relating to the Service is limited to the greater of $50 or the amounts you paid us in the 12 months before the claim. Some jurisdictions don’t allow certain limits, so parts of this section may not apply to you.

15.Indemnification

You agree to indemnify and hold Fish Club harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of Your Content, your use of the Service, your fishing activity, or your violation of these Terms or of any law or third-party right.

16.Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try in good faith to resolve the dispute informally within 30 days. Disputes that can’t be resolved informally will be brought in the state or federal courts located in Utah, and both parties consent to their jurisdiction — except that either party may bring an individual claim in small-claims court.

17.Changes to these Terms

We may update these Terms as the Service evolves. If a change is material, we’ll give notice (for example in-app or by email) before it takes effect. Continuing to use the Service after changes take effect means you accept them. The “Last updated” date above always reflects the current version.
